Abstract
The present text is, basically, a revision of democratic theory from the perspective of its inadequacies with regard to including in its scope many of the recently democratized countries, as well as some older democracies located outside of the Northwestern quadrant of the world. After warning that it is a first step in a larger and more ambitious endeavor, the paper begins by critically examining various definitions of democracy, especially those that, claiming to follow Schumpeter, are deemed to be 'minimalist' or 'processualist'. On this basis a realistic and restricted, but not minimalist, definition of a democratic regime is proposed. After this step the connections of this topic with several others are explored including political, social, and welfare rights; the state, especially in its legal dimension; and some characteristics of the overall social context. The main grounding factor that results form theses explorations is the conception of agency, especially as it is expressed in the legal system of existing democracies-although the effectiveness of this system and of its underlying conception of agency vary quite widely across cases. The approach of the text emphasizes legal and historical factors while also tracing, in several comparative excursus, some important differences among various kinds o f cases. The main conclusions are stated in several propositions, the major thrust of which entails an invitation toward a theoretically disciplined broadening of the analytical and comparative scope of contemporary democratic theory.

El presente texto es, básicamente, una revisión de la teoría democrática desde la perspectiva de su incapacidad para incluir en su alcance tanto a muchos de los países recientemente democratizados como a algunas democracias más antiguas ubicadas fuera del cuadrante Noroccidental del mundo. Luego de advertir que éste es un primer paso en un proyecto de 'democracia', especialmente aquellas que, aduciendo seguir a Schumpeter, suelen ser consideradas 'minimalistas' o 'procesualistas'. Sobre esta base se propone una definición del régimen democrático realista y restringida pero no minimalista. Luego de este paso se exploran las conexiones de este tema con varios otros, incluyendo los derechos políticos, sociales y de bienestar; el estado, especialmente en su dimensión legal; y algunas características del contexto social en general. El aspecto básico que resulta de estas exploraciones es el concepto de agencia, especialmente tal como lo expresa el sistema legal de las democracias contemporáneas; aunque la efectividad de este sistema y de sus concepciones subyacentes de agencia varían ampliamente entre los casas. El enfoque de este texto enfatiza los factores legales e históricos al tiempo que identifica, en Varios excursus comparativos, algunas diferencias importantes entre varios tipos de cass. Las principales conclusiones del presente texto se vuelcan en varias proposiciones, cuya principal intención es contribuir a una ampliación teóricamente disciplinada del alcance analítico y comparativo de la teoría democrática contemporánea.
